Claims Process

1 - Starting the claims process

On receiving a referral we will contact the claimant immediately and take full details of the claim. If a meeting is required and the claimant is unable to come to our offices, we will arrange a meeting in the comfort of their own home.

Secure Law will present the claim to the other party, or their insurers, as soon practical. We will endeavour to obtain an admission of fault from the other party or their insurers within three months of presenting details of the claim.

2 - Negotiating compensation

We will arrange for a personal examination from a medical expert to support the claim for personal injuries. The expert will then prepare a report setting out the nature and extent of the injuries caused by the accident, consider whether treatment is recommended, and estimate how long the symptoms will last.

The level of compensation for the injury claim will be based on several factors, including the nature, extent and severity of the injuries, whether the claimant has fully recovered from the injuries, and how the injuries have affected the claimant’s day to day life. These subjects will be covered in the medical report which we will discuss with you to determine its accuracy.

Once the claimant is happy with the truth of the medical evidence, the report will then be sent to the other party to encourage them to make a fair and reasonable offer of settlement.

3 - Legal action

Most cases are settled by negotiation with the other party, but if we cannot reach agreement, court proceedings will need to be issued and the court will set a timetable to progress the claim.

The time taken to conclude a personal injury case depends on several factors, including how soon the claimant recovers from the injuries sustained, the reasonableness of any offers of compensation and whether court proceedings have to be issued. However, we believe it is in our clients’ best interests to avoid court proceedings if at all possible. Secure Law will only commence these proceedings as a last resort, if sensible proposals to pay the claimant’s compensation are not forthcoming.

In all cases, we will obtain a fair and ethical settlement for our clients as swiftly as possible.
